Responsibilities

  • Key Responsibilities:
  • Strategic Leadership: Oversee the legal function for CMC Markets Germany GmbH (“CMC Germany”) including its European branches, providing strategic legal counsel to the Senior Management Team. Safeguard the best interests and reputation of CMC at all times;
  • Regulatory Compliance: Ensure that legal risk is mitigated to the fullest extent possible and that legal issues are dealt with in accordance with best practice; Identify process improvements to mitigate or eliminate legal risk.
  • Team Management: Lead and develop a high-performing legal team across Europe, including talent acquisition, performance management, and career development
  • Business Partnership: Collaborate closely with all relevant business areas to support new initiatives, new products and major projects.
  • Dispute Resolution: Manage legal disputes, including litigation and regulatory investigations.
  • Industry Knowledge: Stay abreast of legal and regulatory developments in the financial services industry, particularly within the European market. Monitor legal updates and share relevant information with other Legal Team members
  • Stakeholder management: Build and maintain strong relationships with internal and external stakeholders. Act as a key point of contact for CMC’s office heads across Europe. Liaise with legal colleagues in the UK and Australia to ensure important information is shared and provide support where required
  • Contractual Management and Advisory: Draft, review, and negotiate a wide range of Corporate, contractual or legal documents, including inter alia:
  • Maintaining CMCs product legal terms for its trading platforms internationally;
  • Dealing with complaints, debt collection and litigation;
  • Reviewing and negotiating prime brokerage documentation, including ISDA documentation;
  • Reviewing and negotiating finance documentation;
  • Drafting intercompany agreements;
  • Dealing with any property work;
  • Dealing with institutional legal work, including legal documentation and due diligence on new countries;
  • Managing external legal suppliers for value and best effect, keeping costs low without compromising the quality of legal advice received.
  • Undertaking such other duties as may be reasonably required and which are consistent with the general level of responsibility of this role.
  • Supporting Other Departments
  • Assisting the European Compliance Team with responses to complaints, regulatory issues and rule changes that may affect CMC Germany’s business.
  • Ensuring that changes to CMC Germany’s terms of business are compliant with both local regulation and law.
  • Support business expansion initiatives across Europe, including legal due diligence and cross-border considerations
  • Working with other regional Heads of Legal to ensure that CMC’s intellectual property rights around the world are protected and taking necessary action to prevent / stop infringement.
